Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: the hazard of being struck by loads of mixed length lumber ranging from 8 to 20 feet long while it is attached to the Galion Hydraulic Crane by the following "below-the-hook lifting device", i.e., a spreader bar which neither had the rated load capacity visibly displayed, nor an attached nameplate, or other permanent marking, which displayed the manufacturer's name and address, the serial number, lifter weight, and rated load: (Reference ANSI/ASME B30.20-1993, Below-The-Hook Lifting Devices, Section 20-1.2.1(a) and (b)). (a)Between Employee Break Room and the Millwright Shop - There was no rated load capacity, manufacturer's name & address, serial number, lifter weight, etc. marked on the 8 foot long by 6 inch tall by 4.5 inch wide spreader bar used to lift bundles of 8- 20 foot long "missorts" up to the conveyor running to the Sorter. Among other methods one feasible and acceptable method to correct this hazard is to visible mark each under-the-hook lifting device with its appropriate rated load, and affix a data plate with identifying information to each lifting device.
