Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) In the cargo hold of the M.S. Ariane I, employees were permitted to go under a hoisted container in order to place cones on or about December 22, 1988. This practice is contrary to accepted industry practices and exposes employees to the hazard of being struck by a falling load. Referece 29 CFR 1910.179(n)(3)(vi). Among other methods, one feasible and acceptable method to correct this hazard, would be to require that hoisted containers not be moved over areas where employees are located.
