29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Location - Worksite On or about 4/25/2025, employees were exposed to fall hazards from 39 in. to over 20 feet while performing construction activities, where the employer did not ensure that a competent person made frequent and regular inspections of the site. Prior settlement agreements with Lifetime Contractors, Inc. have included requirements for the employer to develop a safety and health management system that incorporated the following elements: management commitment and employee involvement; worksite analysis; hazard prevention and controls; safety and health training. In addition, the employer was required to set up a plan for conducting regular spot checks on jobsites to ensure safety rules were being followed. As per the prior settlement agreements, in consideration of the amendment(s) and/or modification(s) made to the citation(s) for those prior inspections, as well as per required by the OSHA standard, the employer must ensure that a competent person makes frequent and regular inspections of job sites, materials, and equipment. This employer has previously failed to ensure that frequent and regular inspections be performed by a competent person, as seen below: a) Lifetime Contractors Inc. was previously cited for an Other-than-Serious violation of an equivalent occupational safety and health standard, 29 CFR 1926.20(b)(2) which was contained in OSHA inspection number 1703666 citation number 1 item number 1 and was affirmed as a final order on 2/16/2024 with respect to a workplace located at 345 Baker Street, West Roxbury, MA 02132.
