Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls up to eighteen feet due to the misuse of the Dynalift D4P80: (a) On or about April 21, 1993, employee(s) were using a Dynalift D4P80 for purposes other than the manufacturer intended in that the employer was using the carriage of the Dynalift D4P80 as a manlift to install exterior trim to various buildings located at 2750 Moorhead, Boulder CO. A feasible and acceptable abatement method to correct this hazard is to prohibit employees from being lifted by the carriage of the Dynalift D4P80.
