Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls in excess of 12 feet while engaged in maintenance operations on the South Container Crane: Municipal Wharf - South Crane: Employees were not provided with fall protection when involved in daily maintenance operations on the spreader bar of the crane. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install attachment points for safety belt lanyards on the spreader bar and ensure that safety belts are properly worn by all employee involved in the maintenance work.
