OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards. a. Fry Foods, Inc. - Tiffin, Ohio: On or about March 26, 2025, employees who accessed the pallet storage rack system, located in the #2 storage freezer (west), were exposed to struck-by and crushing injuries in that storage racks were not marked with its rated capacity, columns were not anchored to the floor, were missing horizontal and diagonal bracing, and racks presented with multiple areas of damage to column posts, horizontal bracing, diagonal bracing, and base plates. b. Fry Foods, Inc. - Tiffin, Ohio: On or about March 26, 2025, employees who worked in #1 storage freezer (east), were exposed to struck-by and crushing injuries in that the building's supporting I-beams were damaged and removed from their floor anchors. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
