Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards A.) Jobsite located at: 4 Johnson Road, Lawrence, NY 11559 - Area in front of the Crushed Recycled Asphalt Shed. On or about March 10, 2025, a KOMATSU WA500-8 Wheel Loader was operated with the bucket in front raised approximately 13 feet high obstructing a clear line of vision as the operator traversed yard. The wheel loader struck an employee that was walking in front of the Crushed Recycled Asphalt Building towards the shop. That employee was not wearing a high visibility vest, and neither were other employees walking through the yard. The yard had no designated areas for pedestrian traffic, there was no traffic pattern for the use of heavy equipment in the yard, and traffic flow and direction were not marked with signs. Employees walking and working at the facility near heavy equipment such as wheel loaders and dump trucks were not adequately protected from being struck by the heavy equipment. Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19.
