OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to the hazard of being struck-by and caught in/between the load and other material on the jobsite while lifting loads with a hydraulic excavator: A) 355 Exterior Street, Bronx - NY: A Cat 335L hydraulic excavator was used to lift drill-rods onto a flatbed truck, exposing employees on the ground guiding the load with taglines to the hazard of being struck by the load or being caught in/between the load and equipment/materials on the ground, on or about, February 12th, 2025.
