OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards while operating deficient cranes with underhung hoists: a) On or about January 27, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure the rails supporting the monorail cranes with underhung hoists in maintenance shops for chair lifts including, but not limited to, the American Eagle, the American Flyer, and the Super Bee were marked with the correct load-rating capacity when operated daily by employees. This condition exposed employees to crushing hazards. b) On or about January 27, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure the monorail cranes with underhung hoists in maintenance shops for chair lifts including, but not limited to, the American Eagle, the American Flyer, and the Super Bee were inspected before the beginning of each shift when operated daily by employees. This condition exposed employees to crushing hazards. c) On or about January 27, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure the monorail cranes with underhung hoists in maintenance shops for chair lifts including, but not limited to, the American Eagle, the American Flyer, and the Super Bee had the rated load marked on hoists or load blocks and were legible from the ground or floor. This condition exposed employees to crushing hazards.
