OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by and crushing hazards due to not having an escape/retreat path during tree felling operations. a) Worksite, back of residential building: On or about January 27, 2025, employees were manually felling a tree that was approximately 70' in length and a 17" diameter using a STIHL MS 460 Magnum chainsaw. The employer did not ensure that an escape/retreat path was designated and kept clear of obstructions so that employees felling tree trunks had an unimpeded means of egress in case emergency retreat was necessary.
