Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. The hazard of falling from the cargo elevator (side loader) or from the hazard of being caught between the cargo elevator (side loader) and the intermediate deck opening during its upward travel from the lower deck. Employees were permitted to ride indiscriminately the cargo elevator (side loader) with or without cargo from the lower deck to the weather deck of M/V Irving Timber moored to Pier 16, at San Juan, PR. Height of fall from the weather deck to the lower hold was 36 feet. Among others, one feasible and acceptable method to correct this hazard is to provide at least one accessible ladder in the hold, and to prohibit the stevedores from the use of the elevator (side loader) as a means of exit from the hold.
