Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being crushed by the end wall of the 40 ft. flat rack container, while an employee was allowed to hold in place one of the sling legs, in the process of unloading a loaded container using a legs 25 ft. long sling. Aboard M/V Elizabeth, Crown Bay, Saint Thomas, V.I. Among other methods to correct this hazard is using a spreader bar for lifting applying forces vertically from the four fittings designed to lift such container.
