29 CFR 1910.147(c)(4)(ii): Energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to: On or about January 6, 2025, at the worksite located at 1131 Dakota Avenue, Dakota City, Nebraska, an employee engaged in maintenance activities on the Newcastle Load Transfer, serial number 14134, was fatally injured when an electronic sensor that triggered the slave board gantry to lower was activated while the employee was laying underneath of the apparatus. Employees were exposed to caught-in and crushing hazards. The employer did not ensure hazardous energy control procedures for the Newcastle Load Transfer, serial number 14134, included all techniques and rules for employees to control hazardous energy including, but not limited to: i. Specific procedural steps for shutting down, isolating, blocking, and securing the equipment such as correct location for shut-off and isolation points of all potential energy sources and ii. Specific requirements for testing the equipment to determine and verify energy control effectiveness.
