Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did notfurnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees were exposed to the hazard of being struck or crushed by a semi-trailer which was backed up onto the spardeck of the S.S. Ponce by an Ottawa Hustler, truck no. 2169,, that did not have an operational backup alarm. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the trucks back up alarm is operational through a preventative maintenance program. this violation is alleged to have occurred on September 28. 1990.
