29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: (a) 107 Saint Francia St. parking garage 5th level, On or about December 16, 2024 and at times prior thereto; An employee grinding concrete was exposed to continuous noise at a level of 155.3% dose (equivalent to a TWA of 93.1 dBa) which is approximately 1.553 times the permissible exposure level (PEL) for an 8-hour workday of 100% dose (equivalent to a TWA of 90 dBa) and the employer did not administer a continuing, effective hearing conservation program. Sample taken over a 479-minute sampling period with zero exposure used for the 1 minute not sampled.
