Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hazards of fires and/or explosions due to dust collection system not being designed, constructed, and maintained according to established safety and health standards: a. Grinding - Employees working in areas served by the dust collection system were exposed to fire and/or explosion hazards due to the dry type dust collection system not being constructed and maintained properly, such as, but not limited to the following: the dry type collector was not located outdoors, the collection system was used to collect both steel and aluminum, and the system was not adequate as shown by the dust buildup on the wiring and equipment in the area. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to design, construct, and maintain the dust collection system according to established safety and health standards.
