Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to laceration/amputation hazards from rotating parts: a) 659 Buttonwood Ave, Maple Shade, NJ - The employer did not instruct employees about the hazards associated with operating a Stihl TS 420 Cutquik gas cut-off machine and the correct procedures to follow in order to minimize those hazards. An employee was operating a cut-off machine to cut a cast iron pipe located in a trench during utility repairs. The pipe being cut was not supported to prevent pinching of the blade and the blade which was in use was not specifically designed to cut cast iron. During one of the cuts, the cut-off machine kicked back and fatally struck the employee's neck. This condition was noted on or about November 12, 2024. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
