Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were operating forklifts without utilizing the seat belts present. At the worksite located at 6587 Saint Moritz Drive, Osage Beach, Missouri: Employees operating forklifts were exposed to struck-by and/or crushing hazards in the event the operator is ejected from the forklift following a circumstance where the forklift tips over. Employees are engaged in operating forklifts daily. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: (a) Ensure that employees utilize the operator's restraint system that includes that vehicle seatbelt, as recommended by the Moffett Truck Mounted Forklift Equipped with Reach Mast NX Series Operator Manual. References to recommended seatbelt usage can be found in sections A1 Safety Checklist (pages 5-6), A2 Introduction (page 21), and A4 Operating Principles (pages 52-53, 55, 57-58, and 66). (b) Review the company's current forklift training program to ensure it addresses the struck-by, roll over, and caught between hazards related to operating a forklift and apply recommended safety measures to ensure safe operation of the vehicle. (c) Evaluate and revise the existing company seatbelt policy to include actionable enforcement mechanisms for offsite operators. (d) Revise existing disciplinary programs to include operators while delivering goods/materials at offsite locations. Have management officials conduct periodic unannounced observations of forklift use while operated by a certified operator, both at the facility and at delivery locations to enforce disciplinary procedures.
