29 CFR 1910.22(b): Loads. The employer must ensure that each walking-working surface can support the maximum intended load for that surface. a) On 10/21/2024, the employer did not ensure that the newly dug out excavation that met up with the existing blacktop driveway showing fissures at the shipping and receiving for Plant 6 could support the weight of the forklifts including the Linde forklift (model #H20T) weighing 7500 pounds. Employees operating forklifts in and around the excavation on 10/21, 10/25, 10/26, were exposed to tip over hazards from the drop off of the 10" to 14" change in elevation from the excavation and the edge of the walking working surface. On 10/28/2024, the Linde forklift tipped over and landed in the excavation site crushing the employee.
