29 CFR 1910.28(b)(1)(i):The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: (a)Glacial Lakes Energy, LLC dba Aberdeen Energy, LLC at 13435 370th Avenue, Mina, SD 57451: On or about and at times prior to October 15, 2024, the employer did not ensure that employees were protected from falls on a walking-working surface with an unprotected side or edge that was 4 feet or more above a lower level while conducting railcar grain loading operations on top of a railcar in the Dried Distilled Grains loading area. This condition exposed the employees to fall hazards greater than 4 feet. (b)Glacial Lakes Energy, LLC dba Aberdeen Energy, LLC at 13435 370th Avenue, Mina, SD 57451: On or about and at times prior to October 15, 2024, the employer did not ensure that employees were protected from falls on a walking-working surface with an unprotected side or edge that was 4 feet or more above a lower level while conducting railcar grain loading operations from a platform in the Dried Distilled Grains loading area. This condition exposed the employees to fall hazards greater than 4 feet.
