Text For Citation: 01 Item/Group: 001 Hazard:
OSH Act of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing their duties: a) On or about October 7, 2024, at 9700 SW 344th Street, Homestead, Florida, employees were exposed to high ambient heat from working in direct sunlight manually moving dunnage (cribbing). The calculated Wet Bulb Globe Temperature (WBGT) ranged from 30? to 31? (86?-87.8?) while working in direct sunlight performing moderate to high manual labor, wearing long and short sleeves, and long pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee had been working for approximately 1 hour, exhibiting symptoms of heat exhaustion, collapsed and later died as a result of the heat exposure.
