29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system. The employer does not protect each employee required to work from elevations during residential construction activities 6 feet or more above lower levels by providing and ensuring the use guardrail systems, safety net system, or personal fall arrest system, or providing alternative fall protection measures under provisions of paragraph 1926.501(b): This most recently occurred on or about September 26, 2024, employees were exposed to falls of approximately 17.7 feet or more above ground level while engaged in residential construction activities. Fall protection was not being utilized while performing roofing activities. Victor Loja-Tenezaca DBA Victor Manuel was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1491190, citation number 1, item number 2 and was affirmed as a final order on January 20, 2021, with respect to a workplace located at 18254 -18253 Murphy Cr., Tinley Park, IL 60487. Victor Loja-Tenezaca DBA Victor Loja-Tenezaca was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1699742, citation number 1, item number 1, and was affirmed as a final order on October 26, 2023, with respect to a workplace located at 432 Highland Rd., Matteson, IL 60443. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
