OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) LMC Slab and Tile, LLC: On September 26, 2024, and at times prior, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crush by hazards when they manually handled and moved stone slabs, instead of using a forklift with a slab handling attachment, and while working in, or adjected to, the fall shadow area. A total of nine stone slabs, with total weight between 2095 to 2377 pounds, fell on and crushed two employees while the slabs were being moved from an A-Frame storage rack.
