Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each employee a place of employment which was free from a recognized fall hazard that was causing or likely to cause death or serious physical harm to employees: (a) On September 21, 2024, an employee working approximately 35 feet up in a tree, trimming it, was not protected from falling in that the employee was not tied in.
