29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: a) 729 Philadelphia Pike Wilmington, DE 19809 (rear wall): On or about August 29, 2024, the employer failed to ensure safeguards such as missing or damaged ceiling tiles were in place which are required to provide a barrier against the spread of smoke and fire. Properly installed ceiling tiles allow smoke detectors, heat detectors, and sprinkler systems to operate correctly in the event of fire. b) 729 Philadelphia Pike Wilmington, DE 19809 (adjacent to bathroom/front door): On or about August 29, 2024, CSHO observed emergency exit hazards related to emergency evacuation of the building, the emergency lighting located at the front entrance door and adjacent to the employee bathroom had emergency lighting bulbs that were blown and nonfunctional. The inadequate maintenance of the emergency lighting failed to ensure visibility in the event of an emergency evacuation.
