29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Cell-3 Eagle Island: On or about August 19, 2024, where a portion of the cell at the worksite filled with water resulting from excessive rainfall generated by Hurricane Debby, an employee attempted to relocate a water pump hose in effort to dewater the cell by navigating an amphibious excavator across standing water in the cell without first receiving training on how to operate the excavator in a floating state.
