OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards associated with inadequately maintained racking systems: a) Between bays M-009-2 and M-011-2, Section M - On or about August 19, 2024, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets on a damaged steel racking system that had bent upright columns. b) End of bay O-001-1, Section O - On or about August 19, 2024, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets on a damaged steel racking system that had bent upright columns.
