29 CFR 1910.132(d)(1):The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) Inside Tank System Stages 1-14; On or about August 13, 2024, and at times prior, employees were exposed to skin burns and eye damage, in that the employer did not perform an assessment of the tank system to determine if hazards necessitating personal protective equipment were present as Maintenance Technicians retrieve and remove fallen materials from the tank system and perform maintenance activities.
