OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties. a) On or about August 5, 2024, employees were exposed to the hazard of high heat from working under direct sunlight during the performance of their job duties, including transplanting sugar cane period of one day. The National Weather Service issued a heat warning during that one day with a heat index of 109 degrees, 74% humidity and a Globe Temperature of 98 degrees the day of the incident. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. The above conditions resulted in a work-related death of one employee that occurred at approximately 2:00 PM.
