OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they did not ensure that employees did not position themselves in the blind spots at the front of the Wirtgen asphalt milling machine: (a) Jobsite: On or about August 8, 2024, the employer did not have a spotter for the blind spots as the Wirtgen asphalt milling machine was traveling forward. There were two employees at the front left of the machine and one of them was struck and run over by the front left track of the machine.
