Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that tank vehicles equipped for vapor control were bottom-loader and were vented to the atmosphere at a height lower than the top of the cargo tank: a) Loading rack at the Tampa Citgo Terminal, transport vehicles were vented out the rear vapor pipe during loading operations while the terminals vapor processing system was not in good working order, on or about 04/15/90. One method of abatement, among others, would be to discontinue rack loading operations until the vapor process system was returned to good working order.
