Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposing them to a struck-by hazard: a) On or about August 2, 2024, at a worksite located at 10300 Baltimore Ave. Beltsville, MD, the employer allowed employees to off-load shoring panels with a Caterpillar 926 front end loader which was equipped with a fork attachment that was not large enough to safely support the panels, causing them to be unsecured and unbalanced. This activity exposed employees to a struck-by hazard which resulted in a fatality. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet). In addition, documentation demonstrating that the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
