29 CFR 1926.651(f): A warning system such as barricades, hand or mechanical signals, or stop logs was not utilized when mobile equipment was operated adjacent to an excavation, when such equipment was required to approach the edge of an excavation: a) Tyre Road & Delaware Avenue, Newark, DE: On August 5, 2024, it was observed by the compliance officer that a 135C-SANY, excavator being operated was positioned at the trench's edge performing an excavating operation while employee(s) were working within the trench. The operator was observed positioning the excavator's bucket over the head of an employee working within the trench and beside another.
