29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: a) Job site, near the corner of California Avenue and Superior Avenue, Pittsburgh, PA: On or about July 26, 2024, during excavation activities, the employer did not ensure that workers were removed from an excavation determined to be approximately 6 feet deep where it was determined that the existing protective system was not appropriate for the excavation and where there was no safe way to egress the excavation.
