Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees were exposed to the hazard of being struck by ruptured water tank and/or fragments of steel due to the over-pressurization of a non-rated 1000 gallon water tank on 1/29/90. Among other methods, one feasible and acceptable method to correctthis hazard is to pressurize only an ASME coded tank provided with a safety relief device and a pressure regulator device on the air supply line.
