29 CFR 1926.20(b)(2): The employer does not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: (a) The employer is failing to protect each employee engaged in gutter and other associated operations. The employer does not inspect jobsites on a frequent and regular basis for the purposes of ensuring employee safety. The employer did not develop or implement a safety program to discover safety violations and implement abatement. On or before 7/8/2024, and at times prior, this practice led to the employer not protecting employees from exposure to fall hazards in excess of 6 feet. The employer does not have a program in place to ensure compliance with fall protection requirements and other applicable safety and health regulations. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure employees engaged in residential construction activities are regularly inspected by a competent person to ensure adherence to applicable safety and health standards and the wellbeing of work crews.
