Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of entrapment between the forklift and the ground: (a) 5353 Bernville Road, Bernville, Pennsylvania - An employee operated the Clark C25 sit-down rider forklift to pick up and move slabs and remnants of granite and other stone. The forklift had an operator protection device (which included a seatbelt), but the employee did not use the seatbelt at all times while operating the forklift, exposing the employee to the hazard of entrapment between the forklift and the ground in the event of a forklift tip over, on or about July 11, 2024. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
