Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Main elevator, truck dump - approximately 5 feet by 7 feet. b) Outside storage dump - approximately 5 feet by 7 feet. The hazard of dust explosion created by tramp metal entering the grain flow system through the unloading grates and could cause sparks. Among other methods, one feasible and acceptable abatement method to correct this hazard is the welding of rebar on existing grating to a 2 1/2 inch by 2 1/2 inch maximum opening.
