29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present which necessitated the use of personal protective equipment (PPE): York Analytical Laboratories Inc. (II), 132-02 89th Avenue, Suite # 217, Richmond Hill, NY 11418. a) On or about 5/29/2024, Lab Technician employees engaged in routine use of corrosive chemicals such as, but not limited to, Sodium hypochlorite solution (>= 10 - < 20 %), methanol (<= 100 %), and formic acid (99%) without eye protection equipment. The employer did not adequately assess the workplace to determine if hazards were present that required the need of proper personal protective equipment to protect employees from corrosive chemicals. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
