OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) The employer did not conduct Functional Test Inspections of the Leon Electric 2-ton electric-powered crane, located in Plant 1, to ensure that it was in safe working order, exposing employees to struck-by and crushing hazards while operating the hoist to lift and suspend modular building walls and roofs, on or about June 6, 2024. b) The employer did not conduct Frequent Inspections of the Leon Electric 2-ton electric-powered crane, located in Plant 1, to ensure that it was in safe working order, exposing employees to struck-by and crushing hazards while operating the hoist to lift and suspend modular building walls and roofs, on or about June 6, 2024. c) The employer did not identify, document, and assign responsibilities of the hoist operator and other persons involved in the movement of the load(s) of the Leon Electric 2-ton electric-powered chain hoist, located in Plant 1, to ensure that it was in safe working order, exposing employees to struck-by and crushing hazards while operating the hoist to lift and suspend modular building walls and roofs, on or about June 6, 2024. d) The employer did not provide or verify that persons who will operate the equipment have been trained on the Leon Electric 2-ton electric-powered crane, located in Plant 1, to ensure safe operation, this exposed employees to struck-by and crushing hazards while operating the hoist to lift and suspend modular building walls and roofs, on or about June 6, 2024. e) The employer did not conduct Functional Test Inspections of the Dearborn 25-ton crane, located in Plant 2, to ensure that it was in safe working order, exposing employees to struck-by and crushing hazards while operating the crane to lift and suspend steel building materials, on or about June 6, 2024. f) The employer did not conduct Frequent Inspections of the Dearborn 25-ton crane, located in Plant 2, to ensure that it was in safe working order, exposing employees to struck-by and crushing hazards while operating the crane to lift and suspend steel building materials, on or about June 6, 2024. g) The Dearborn 25-ton crane, located in Plant 2 used to lift steel building materials, was not securely attached to the load in that the hook was missing its safety latch, exposing employees to being struck-by and crushed-by suspended loads, on or about June 6, 2024. h) The employer did not identify, document, and assign responsibilities of the hoist operator and other persons involved in the movement of the load(s) of the Dearborn 25-ton crane, located in Plant 1, to ensure that it was in safe working order, exposing employees to struck-by and crushing hazards while operating the crane to lift and suspend steel building materials, on or about June 6, 2024. i) The employer did not provide or verify that persons who will operate the equipment have been trained on the Dearborn 25-ton crane, located in Plant 2, to ensure safe operation, this exposed employees to struck-by and crushing hazards while operating the crane to lift and suspend steel building materials, on or about June 6, 2024. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
