OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a roll-over hazard. On or about June 2, 2024, employees operated a Gravely Pro-Turn 260 KAW lawnmower on inclines and near waterways without ensuring that the roll over protective structure (ROPS) was fully extended and the upright position.
