Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) A POSSIBLE EXPLOSIVE ATMOSPHERE WHEN SPRAYING OPERATIONS WERE PERFORMED IN THE MAINTENANCE AREA. THE SPRAYING INCLUDED THE PAINTING OF TRUCKS AND OTHER EQUIPMENT IN AN AREA WHERE ELECTICAL EQUIPMENT WAS LOCATED. THIS EQUIPMENT WAS NOT RATED FOR CLASS A DIVISON 1, USAGE. THE EQUIPMENT INCLUDED ELECTRICAL OUTLETS, FLOURESCENT LIGHTING, PORTABLE LIGHTS, AND BATTERY CHARGING EQUIPMENT. ONE FEASIBLE METHOD TO HAVE CORRECTED THIS HAZARD WOULD HAVE BEEN TO INSTALL A SPRAY BOOTH WITH THE CORRECT ELECTRICAL EQUIPMENT AND VENTILATION INSTALLED WITHIN THE BOOTH.
