The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: a) On or about May 29, 2024, at Circle K Stores, Inc. Store 2709066 located at 1024 Ann St. Montgomery, AL 36107, customers exchanged gunfire during an altercation with a cashier, who was standing behind the register, and fatally shot the cashier.
