OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-against hazards while operating a company vehicle with a defective emergency brake system. (a) Worksite: On or about 5/31/24, an employee was exposed to struck-against hazards while working from a vehicle-mounted elevated platform on a Dodge 4500 truck with a defective emergency braking system that would not prevent the vehicle from moving forward when placed in drive.
