29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: (a) On or about May 29, 2024, at 18317 Highway 144, Fort Morgan, CO: The employer did not assess the lower pump house to determine if hazards were present, or likely to be present, which would necessitate the use of PPE. The employer did not ensure a hazard assessment was performed and personal protective equipment was assigned during a line break and pump removal in the lower pump house. This condition exposed employees hands, arms, face, and body to contaminated water as a result of performing maintenance on pumps. Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following: (1) Identifies the workplace evaluated; (2) The person certifying that the evaluation has been performed; (3) The date(s) that the hazard assessment was performed; and (4) Which identifies the document as a certification of hazard assessment.
