Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following hazard: a.On or about July 28, 1999, employees were exposed to the hazard of being crushed in unsecured pinch point while working on a "Bobcat" model 873 bucket loader on the deck of the work barge. One feasible means of correcting the hazard is to use the safety equipment required and supplied by the manufacturer which was available at the site and to perform repairs using manufacturer's guidelines.
