Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likley to cause death or serious physical harm to employees in that tower crane operator(s) and other employees were exposed to the hazards of collapse of tower crane boom(s), falling loads(s), toppled tower crane(s), and being struck by moving tower crane(s) and load(s). a) On or about October 4, 1985, and at other times, tower crane(s) were operated by employee(s) who were not qualified by extensive knowledge training and experience. One feasible and acceptable abatement method, among others, is to develop and implement a training program for tower crane operators and supervisors, which shall include a thorough familiarization of the equipment, and of the equipment manuals, published by the equipment manufacturer, and direct supervision by a qualified operator, until proficiency in crane operations and inspections has been demonstrated. Training shall emphasize the proper procedures for operators and supervisors regarding the operator's authority to stop and refuse to handle load(s) until safety has been assured.
