29 CFR 1910.22(a)(1): The employer must ensure all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. The employer does not ensure that all places of employment are kept from hazardous accumulations of combustible dust(s). This condition was most recently documented as follows: On or about April 30, 2024, the Vortex Dryer Room high horizontal surfaces, including, but not limited to, wall ledge surface(s) and wall brace surface(s), had excessive accumulations of combustible dust, such as cornstarch. Impact Confections, Inc. (dba Kua Candy LLC) was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.22(a)(1), which was contained in OSHA inspection number 1647953, citation number 2, item number 1a and was affirmed as a final order on June 28, 2023, with respect to a workplace located at 4017 Whitney Street Janesville, WI 53546. Impact Confections, Inc. (dba Kua Candy LLC) was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.22(a)(1), which was contained in OSHA inspection number 1519144, citation number 1, item number 2 and was affirmed as a final order on October 1, 2021, with respect to a workplace located at 4017 Whitney Street Janesville, WI 53546. To abate this violation the employer must ensure that horizontal surfaces are kept free of hazardous accumulations of combustible dust(s) through methods such as, but not limited to: (1) identification of sources of fugitive dust emissions, (2) sealing and/or point source capture of identified sources of fugitive dust emissions, (3) frequent inspection of elevated horizontal surfaces for the presence of hazardous levels of combustible dust, and (4) safe removal of accumulated levels of fugitive dust emissions on elevated horizontal surfaces before reaching hazardous levels of accumulation. 29 CFR 1910.19(c) requires the employer to provide certification of abatement to include the date an method of abatement and a statement that affected employees and their representatives have been informed of the abatement. 29 CFR 1910.19(d) requires the employer to provide, in addition to the information on abatement certification, documents demonstrating that abatement is complete for each violation where such abatement documentation is required. Documents demonstrating that abatement is complete, may include, but are not limited to, photographic or video evidence of abatement, written program documentation, etc.
