OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazards of a below-the-hook lifting device failing: (a) Metal Fabrication Area: on June 4, 2024 and times prior thereto, employees operated a 15/5-ton Shaw Box crane S/N # 38783, to hoist, move and reposition steel transformer housings weighing up to 15-tons with use of a below-the-hook lifting device. The below-the-hook lifting device did not have identification listing the manufacturer's name, address, serial number, and load capacity. Employees were exposed to being crushed-by steel transformer housings in the case of the below-the-hook lifting devices failure.
