1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. 29 CFR 1926.502(h)(1)(iii):The safety monitor wan not on the same walking/working surface and within visual sighting distance of the employee being monitored: On or about April 24, 2024 the employer Damschroder Roofing, Inc. at jobsite located at 2500 W. State St. Fremont OH 43420, failed to ensure the designated safety monitor was in a position within visual sighting distance to observe all employees working on the edge of the roof deck. Five employees were exposed to falls of 13 feet and 7 inches to the ground below while working at heights without the protection of a designated safety monitor.
